General Terms and Conditions
1. Applicability
These General Terms and Conditions apply to all quotations, agreements, and deliveries by gmsportsafety.com, unless otherwise explicitly agreed in writing.
If the Customer includes terms or conditions in its order, confirmation, or communications that differ from these General Terms and Conditions (or imply acceptance of such differing terms), these shall only be binding on gmsportsafety.com if and when explicitly accepted in writing by gmsportsafety.com.
2. Offer
Where an offer has a limited validity period or is subject to specific conditions, this will be clearly stated in the offer.
The offer contains a complete and accurate description of the products and/or services offered—detailed enough to allow the Customer to properly evaluate it. Any images used by gmsportsafety.com truthfully represent the offered products and/or services, though colors in photographs may vary from the actual goods due to the Customer’s screen settings. Obvious errors or mistakes in the offer shall not be binding on gmsportsafety.com.
3. Agreement
Subject to the provisions of paragraph 4, the Agreement is formed when the Customer accepts the offer and meets the conditions outlined therein.
If the Customer accepts the offer electronically, gmsportsafety.com will immediately confirm receipt of this acceptance. Until this confirmation is sent, the Customer may cancel the Agreement.
For Agreements concluded electronically, gmsportsafety.com will implement appropriate technical and organizational measures to ensure secure data transmission and network environments. For electronic payments, suitable security measures will be applied.
Within legal limits, gmsportsafety.com may verify the Customer’s ability to fulfill payment obligations and other factors relevant to responsibly concluding a remote agreement. If, based on this assessment, gmsportsafety.com has valid reasons not to proceed, it may refuse the order (with explanation) or impose special conditions on fulfillment.
4. Right to Withdraw (for Products)
When purchasing products, the Customer may cancel the Agreement within 14 days without providing a reason. This period starts the day after the Customer or their representative receives the products.
During this period, the Customer must handle products and packaging with care. Packaging may be opened, and products may be tried on, but only to the extent necessary to decide whether to keep them (trying on does not count as “use”). If the right to withdraw is exercised, the Customer must return the product—along with all included accessories (where reasonable)—in its original condition and packaging, following gmsportsafety.com’s clear, reasonable instructions.
If the Customer has made a payment, gmsportsafety.com will refund the amount as soon as possible, but no later than 30 days after the return or cancellation.
5. Exclusion of the Right to Withdraw
gmsportsafety.com may only exclude the right to withdraw if this is clearly stated in the offer, well in advance of the Agreement being concluded. This exclusion applies to:
– Products that are clearly personalized;
– Products that cannot be returned due to their nature.
6. Price
During the valid period specified in the offer, product and/or service prices will remain unchanged, except for adjustments caused by changes in VAT rates or other government-imposed taxes.
Prices stated in the offer include VAT.
An agreement is only formed once gmsportsafety.com accepts the order. gmsportsafety.com reserves the right to reject an order (with reasons) or impose delivery conditions, unless stated otherwise. If an order is rejected (e.g., due to prior fraud, credit checks, or blacklisting), notification will be provided within 2 working days of receiving the order.
7. Conformity and Warranty
gmsportsafety.com guarantees that products and/or services comply with the specifications, reasonable reliability, and availability standards outlined in the Agreement, Offer, and applicable conditions as of the offer date. This is subject to existing legal provisions and government regulations.
Manufacturer or importer guarantees do not limit the Customer’s legal rights or claims against gmsportsafety.com for failure to fulfill obligations under the law or distance contracts.
Complaints and comments will be responded to as soon as possible, but no later than 14 days from receipt. If a longer processing time is needed, gmsportsafety.com will acknowledge receipt within 14 days and specify when a detailed response can be expected.
8. Delivery and Execution
gmsportsafety.com will exercise due care in receiving, processing, and fulfilling product orders, and in evaluating service requests.
Delivery will be made to the address provided by the Customer.
The website will clearly state delivery methods and timelines before the Agreement is concluded. If no delivery period is agreed, products will be delivered within 30 days.
If gmsportsafety.com cannot meet the agreed delivery period, it will notify the Customer, who may either agree to a new date or cancel the Agreement free of charge.
Accepted orders will be fulfilled promptly, but no later than 30 days (unless a longer period is agreed). If delivery is delayed, or the order is unfulfillable (in whole or part), the Customer will be notified within one month of the order. The Customer may then cancel the Agreement free of charge but is not entitled to compensation.
Unless otherwise agreed, gmsportsafety.com bears the risk of damage or loss to products until delivery to the Customer. For returns, the Customer bears this risk until the products are received by gmsportsafety.com.
9. Payment
Unless agreed otherwise, full payment is required in advance via online methods (credit cards: Eurocard, Visa; or iDEAL), subject to approval by the payment processor. No extra fees apply to online payments.
The Customer must immediately notify gmsportsafety.com of any errors in provided or stated payment details.
gmsportsafety.com accepts VISA and MASTERCARD. For credit card payments, the amount is debited immediately upon payment confirmation.

Customers may return or exchange products within 30 days of delivery for any reason, provided items are unused, in original packaging, with price tags/stickers attached. When exercising this right, products (and accessories, where reasonable) must be returned as per gmsportsafety.com’s instructions.
Refunds for returned products in good condition will be processed within 14 days, using the same payment method as the original purchase.
11. Force Majeure
In the event of force majeure, gmsportsafety.com may, at its discretion, suspend order fulfillment or terminate the Agreement by written notice, without court intervention. It shall not be liable for compensation, unless this is unreasonable under the specific circumstances. Force majeure includes any failure not attributable to gmsportsafety.com (i.e., not due to its fault, legal liability, or generally accepted responsibility).
12. Privacy
gmsportsafety.com does not sell customer data to third parties. Data is only shared with third parties if necessary for them to perform services on its behalf or to comply with legal requirements. For details, see the privacy statement (click here).
13. Miscellaneous
Orders will be shipped to any address provided in writing to gmsportsafety.com, unless written notice of a different address is received.
gmsportsafety.com’s temporary or ongoing deviation from these terms does not waive its right to enforce strict compliance. No claims may be based on such flexibility.
If any provision of these terms (or other agreements with gmsportsafety.com) conflicts with applicable law, that provision is invalid and will be replaced by a legally permissible alternative that best matches the original intent. Other provisions remain unaffected.
gmsportsafety.com may engage third parties to enforce this Agreement.
14. Applicable Law and Jurisdiction
All rights, obligations, offers, orders, agreements, and these General Terms and Conditions are governed by [applicable law]. All disputes shall be resolved exclusively by the competent courts.
